The rules for using Lumasto.

1. Agreement to terms

These Terms of Service ("Terms") form a binding agreement between you and Lumasto Learning LLC ("Lumasto", "we", "us") governing your access to and use of the Lumasto website, web application, and browser extension (together, the "Service").

By creating an account or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you are using the Service on behalf of an organisation, you confirm you have authority to bind that organisation to these Terms.

2. Eligibility

You must be at least 16 years old to create an account. By using the Service you represent that you meet this requirement and that the information you provide during registration is accurate and complete.

3. Accounts and security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@lumasto.app if you suspect unauthorised access. We are not liable for losses caused by unauthorised use of your account that results from your failure to safeguard your credentials.

4. Subscriptions and billing

Lumasto offers a free tier and paid Student, Pro, and Team subscription plans. Paid plans are billed in advance on a monthly or annual basis and automatically renew until cancelled.

• You authorise us and our payment processor to charge your chosen payment method for all fees due.
• Prices are shown exclusive of applicable taxes unless stated otherwise; taxes are added at checkout where required.
• You can cancel a subscription at any time from account settings; cancellation takes effect at the end of the current billing period, and you retain access until then.
• Except where required by law, fees already paid are non-refundable. We may offer refunds or credits at our discretion, for example where a paid feature was unavailable due to an error on our part.
• We may change subscription prices with at least 30 days' notice; continued use after a price change takes effect constitutes acceptance of the new price.

5. Free trials and promotions

We may offer free trials or promotional pricing for paid plans. Unless stated otherwise, a trial converts automatically into a paid subscription at the standard price when it ends, and you will be charged unless you cancel before the trial expires.

6. Your content and licence to us

"User Content" means documents, links, words, notes, audio, and other material you upload, paste, or save through the Service. You retain all ownership rights in your User Content.

You grant Lumasto a limited, non-exclusive, worldwide licence to host, store, process, and display your User Content solely to operate and improve the Service for you, including to generate lessons, vocabulary, and practice material. This licence ends when you delete the relevant content or close your account, subject to the retention periods described in our Privacy Policy.

You are responsible for your User Content and confirm that you have the necessary rights to upload it and that it does not infringe any third party's rights or violate applicable law.

7. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Upload content that infringes intellectual property rights, contains malware, or violates the privacy of others.
• Attempt to gain unauthorised access to the Service, other accounts, or related systems or networks.
• Reverse engineer, decompile, or attempt to extract the source code of the Service, except where permitted by law.
• Use automated means to scrape, crawl, or extract data from the Service without our prior written consent.
• Resell, sublicense, or provide access to the Service to third parties without authorisation.
• Use the Service to build a competing product.

8. AI-generated content

The Service includes features that generate lessons, translations, chat responses, and practice material using automated and AI-assisted systems. This content is provided for learning purposes only, may contain inaccuracies, and should not be relied upon as professional, legal, medical, or financial advice. You are responsible for evaluating the accuracy and appropriateness of any AI-generated content before relying on it.

9. Our intellectual property

The Service, including its software, design, text, graphics, and trademarks, is owned by Lumasto or our licensors and is protected by intellectual property laws. Except for the limited right to use the Service as permitted by these Terms, we do not grant you any rights to our intellectual property.

10. Third-party services

The Service may integrate with or rely on third-party services, including cloud infrastructure and AI model providers. We are not responsible for the availability or performance of third-party services, and your use of them may be subject to additional terms provided by those third parties.

11. Termination

You may stop using the Service and close your account at any time from account settings. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service, with notice where reasonably practicable. Sections that by their nature should survive termination, including ownership, disclaimers, and limitation of liability, will survive.

12. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that learning outcomes will meet your expectations.

13. Limitation of liability

To the maximum extent permitted by law, Lumasto will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months preceding the claim, or 100 EUR if you have not made any payments.

14. Indemnification

You agree to indemnify and hold Lumasto harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

15. Governing law and disputes

These Terms are governed by the laws of Ireland, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Ireland, except where mandatory consumer protection law gives you the right to bring a claim in your home jurisdiction.

16. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through an in-product notice at least 14 days before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
